Supreme Court Decision
The Supreme Court of Montenegro has overturned a previous ruling that approved the extradition of Terra founder Do Kwon to South Korea. The court found that lower courts had not followed proper procedures in their initial approval of the extradition.
Procedural Violations
The Supreme Court stated that the Court of Appeal had violated proceedings by not hearing the state prosecutor, as required by law. Additionally, the lower courts had conducted abbreviated proceedings instead of regular proceedings, which exceeded their authority.
Kwon’s Arrest and Charges
Kwon was arrested in Montenegro in March 2023 while attempting to flee to the United Arab Emirates using a forged passport. He faces criminal charges in the United States and South Korea related to the collapse of Terra and its stablecoin, which resulted in billions of dollars in losses.
Earlier Extraditon Revoked
Earlier this month, Kwon’s extradition to the United States was also revoked due to procedural violations. The ongoing legal proceedings highlight the complex international legal landscape surrounding the extradition of individuals facing criminal charges in multiple jurisdictions.
